백색소음 앱 이용약관

본 이용약관(이하 “본 약관”)은 에스지티에이치엘(SGTHL, 이하 “운영자”)이 제공하는 백색소음 모바일 애플리케이션(이하 “앱”) 및 이와 관련된 모든 서비스(이하 “서비스”)의 이용과 관련하여 운영자와 이용자 간의 권리, 의무 및 책임사항과 기타 필요한 사항을 규정함을 목적으로 합니다.
이용자는 앱 최초 실행, 유료 서비스 구매 또는 기타 약관 동의 과정에서 본 약관을 확인하고 동의한 후 서비스를 이용하여야 합니다. 특히 제2조의 서비스 성격 및 한계와 제12조의 면책조항을 충분히 확인하시기 바랍니다.
제1조 (목적)
본 약관은 운영자가 제공하는 백색소음, 자연음, 수면 보조 음원 및 관련 서비스의 이용조건과 절차, 이용자와 운영자 간의 권리·의무 및 책임사항을 규정함을 목적으로 합니다.
제2조 (서비스의 성격 및 한계)
① 본 앱은 일상의 휴식, 수면 환경 조성 및 집중 분위기 형성을 보조하기 위해 백색소음, 자연음 등의 오디오 콘텐츠를 제공하는 엔터테인먼트 및 생활 보조 애플리케이션입니다.
② 본 앱은 다음 각 호에 해당하지 않습니다.
1. 의료기기 또는 이에 준하는 제품
2. 의학적 진단·치료·예방을 위한 도구
3. 불면증, 수면장애, 불안장애, 우울증, 주의력결핍과잉행동장애(ADHD) 등 의학적 질환에 대한 치료 수단
4. 의약품 또는 의약품의 대체재
5. 영유아의 수면을 유도하거나 진정시키기 위한 의료적 보조 수단
③ 운영자는 본 앱 이용을 통해 다음 각 호의 효과가 발생한다고 보장하지 않습니다.
1. 수면의 질 개선 또는 수면 시간 증가
2. 불면증, 수면장애, 불안장애 등 의학적 증상의 완화 또는 치료
3. 집중력, 기억력 또는 학습 능력 향상
4. 정서적 안정, 스트레스 감소 또는 정신 건강 개선
5. 영유아의 수면 유도 또는 진정 효과
④ 의학적 도움이 필요한 경우 이용자는 의료 전문가와 상담하여야 하며, 본 앱의 이용은 의료 전문가의 진단이나 치료를 대체하지 않습니다.
⑤ 운영자가 직접 작성·승인·의뢰하지 않은 외부 광고, 후기, 게시물 또는 제3자 콘텐츠에서 본 앱의 의료적·치료적 효능을 주장하더라도 이는 운영자의 공식 입장이 아닙니다.
⑥ 운영자의 공식 입장은 본 약관, 개인정보처리방침 및 운영자가 직접 운영하는 공식 채널에 게시된 내용으로 한정합니다.
⑦ 이용자는 본 조에 규정된 서비스의 성격과 한계를 이해한 상태에서 서비스를 이용하여야 합니다.
제3조 (용어의 정의)
본 약관에서 사용하는 용어의 뜻은 다음과 같습니다.
1. “앱”이란 운영자가 제공하는 백색소음 모바일 애플리케이션을 의미합니다.
2. “서비스”란 운영자가 앱을 통해 제공하는 모든 콘텐츠와 기능을 의미합니다.
3. “이용자”란 본 약관에 동의하고 서비스를 이용하는 자를 의미합니다.
4. “프리미엄 서비스”란 구독, 인앱결제 또는 기타 유료 결제를 통해 이용할 수 있는 서비스를 의미합니다.
5. “콘텐츠”란 앱에서 제공되는 음원, 이미지, 텍스트 및 기타 자료를 의미합니다.
6. “앱 마켓”이란 Apple App Store, Google Play 등 앱을 배포하고 결제를 처리하는 플랫폼을 의미합니다.
제4조 (서비스의 내용 및 변경)
① 운영자는 다음 각 호의 서비스를 제공할 수 있습니다.
1. 백색소음 및 자연음 오디오 콘텐츠
2. 수면 및 집중 환경 조성 보조 기능
3. 타이머 및 반복재생 기능
4. 즐겨찾기 및 이용자 설정 기능
5. 최초 이용일부터 14일간 제공되는 무료 이용 기간
6. 구독 또는 인앱결제를 통한 프리미엄 서비스
7. 기타 운영자가 추가로 개발하거나 제공하는 서비스
② 운영자는 서비스 개선, 유지보수, 기술적 필요 또는 운영상 필요에 따라 서비스의 일부를 변경하거나 추가할 수 있습니다.
③ 서비스 변경이 이용자에게 중대한 영향을 미치는 경우 운영자는 변경 내용과 적용일을 앱 내 공지, 이메일 또는 기타 합리적인 방법으로 사전에 알립니다.
④ 운영자가 유료 서비스의 핵심 내용을 중단하거나 이용자에게 불리하게 중대하게 변경하는 경우에는 관련 법령과 앱 마켓 정책에 따라 대체 서비스 제공, 이용기간 연장, 환불 또는 기타 필요한 조치를 취합니다.
제5조 (이용계약의 성립 및 이용자의 자격)
① 이용계약은 이용자가 앱 내에서 본 약관을 확인하고 동의한 후 서비스를 이용함으로써 성립합니다.
② 만 14세 미만의 아동이 개인정보 제공 또는 계정 생성이 필요한 서비스를 이용하는 경우에는 법정대리인의 동의를 받아야 합니다.
③ 미성년자가 유료 서비스를 구매하는 경우 관계 법령에 따라 법정대리인의 동의가 필요할 수 있습니다.
④ 미성년자가 법정대리인의 동의 없이 결제한 경우 본인 또는 법정대리인은 관계 법령에 따라 해당 계약을 취소할 수 있습니다. 다만, 법정대리인이 처분을 허락한 재산의 범위에서 결제한 경우 등 관계 법령상 취소가 제한되는 경우는 제외합니다.
⑤ 앱 마켓을 통해 이루어진 결제의 취소 및 환불 신청은 원칙적으로 해당 앱 마켓이 제공하는 절차를 통해 처리됩니다.
⑥ 보호자가 영유아 또는 의학적 관리가 필요한 사람의 주변 환경에서 앱을 이용하는 경우 보호자는 적정 음량, 이용 시간, 기기 위치 및 이용 환경을 관리하여야 합니다.
제6조 (이용자의 의무)
① 이용자는 다음 각 호의 행위를 하여서는 안 됩니다.
1. 앱 또는 서비스의 정상적인 운영을 방해하는 행위
2. 앱을 불법적인 목적으로 사용하는 행위
3. 운영자 또는 제3자의 지식재산권을 침해하는 행위
4. 앱 내 콘텐츠를 허가 없이 복제, 배포, 판매, 전송 또는 상업적으로 이용하는 행위
5. 해킹, 리버스 엔지니어링, 디컴파일, 비정상적인 데이터 접근 등 앱의 구조나 소스코드를 분석하려는 행위
6. 무료 이용 기간이나 구독 권한을 부정한 방법으로 조작·연장하는 행위
7. 타인의 계정, 개인정보 또는 결제수단을 허가 없이 사용하는 행위
8. Apple Media Services Terms and Conditions, Google Play 이용약관, 이동통신사 약관 또는 적용 가능한 제3자 서비스 약관을 위반하는 행위
9. 본 앱을 의료기기 또는 치료 수단으로 오인하게 하거나 의료적 효능이 있는 것처럼 표시·광고·전파하는 행위
10. 기타 관계 법령 또는 공공질서에 위반되는 행위
② 이용자가 본 약관 또는 관계 법령을 위반한 경우 운영자는 위반 정도에 따라 경고, 서비스 이용 제한 또는 이용계약 해지 등의 조치를 취할 수 있습니다.
③ 운영자는 이용 제한 조치를 취하는 경우 원칙적으로 그 사유를 이용자에게 알립니다. 다만, 긴급한 보안 조치가 필요하거나 법령상 통지가 제한되는 경우에는 그러하지 않을 수 있습니다.
제7조 (제3자 서비스)
① 앱은 광고를 포함하지 않으며, 광고 수익 목적으로 이용자 정보를 처리하지 않습니다.
② 운영자는 오류 분석, 서비스 이용 통계 분석, 무료 이용 기간 확인 및 품질 개선을 위해 다음과 같은 제3자 서비스를 사용할 수 있습니다.
1. Firebase Analytics, Firebase Crashlytics, Cloud Firestore 등 Google Firebase 서비스
3. Apple이 제공하는 앱 배포·결제·분석 서비스
4. Google이 제공하는 앱 배포·결제·분석 서비스
5. 기타 앱 운영에 필요한 통계, 오류 분석 및 보안 서비스
③ 실제 사용되는 제3자 서비스, 수집되는 정보의 항목, 이용 목적, 보유 기간, 국외 이전 또는 제3자 제공에 관한 사항은 개인정보처리방침에 따릅니다.
④ 실제 수집되는 정보는 앱의 기능, 앱 버전, 이용자의 동의 여부, 운영체제 및 기기 설정에 따라 달라질 수 있습니다.
⑤ 운영자는 자신이 직접 작성·승인·의뢰하지 않은 외부 서비스, 외부 링크 또는 제3자 콘텐츠의 내용, 정확성 또는 신뢰성을 보증하지 않습니다.
⑥ 제3자 콘텐츠나 외부 게시물에 의료·치료 효과를 암시하는 내용이 포함되어 있더라도 운영자가 직접 승인하거나 의뢰하지 않은 경우에는 운영자의 공식 입장으로 간주되지 않습니다.
제8조 (유료 서비스 및 구독)
① 앱의 일부 콘텐츠 또는 기능은 구독, 인앱결제 등의 방법으로 유료로 제공될 수 있습니다.
② 유료 서비스의 가격, 결제 주기, 이용 기간, 자동갱신 조건 및 제공 내용은 구매 화면에 표시합니다. 가격은 이용자의 국가와 앱마켓 통화에 따라 다르게 표시될 수 있습니다.
③ 결제는 이용자가 앱을 다운로드한 Apple App Store, Google Play 또는 기타 적용 가능한 앱 마켓의 결제 시스템을 통해 처리됩니다.
④ 자동 갱신 구독은 다음 각 호와 같이 운영됩니다.
1. 이용자가 현재 구독 기간 종료 전에 자동갱신을 해제하지 않는 경우 구독은 구매 화면에 표시된 조건에 따라 자동 갱신될 수 있습니다.
2. 갱신 결제 시점은 이용자가 이용하는 앱 마켓의 정책과 구매 화면에 표시된 내용에 따릅니다.
3. 이용자는 Apple 계정의 구독 관리 화면 또는 Google Play의 정기결제 관리 화면에서 자동갱신을 해지할 수 있습니다.
4. 운영자는 최초 이용일부터 14일간 앱의 모든 기능을 무료로 제공합니다. 이 무료 이용 기간은 앱마켓의 무료 체험 상품이 아니라 운영자가 직접 제공하는 것이므로, 기간이 끝나도 유료 구독이 자동으로 시작되거나 결제되지 않습니다. 무료 이용 기간이 끝난 뒤 계속 이용하려면 이용자가 직접 구독 상품을 선택하여 결제하여야 하며, 이때부터 위 자동갱신 조건이 적용됩니다. 앱을 삭제하고 다시 설치하더라도 무료 이용 기간은 처음부터 다시 시작되지 않습니다.
⑤ 구독 해지는 다음 결제일부터 적용되는 것이 원칙이며, 이미 결제된 구독 기간의 이용 가능 여부와 환불 여부는 관계 법령 및 앱 마켓 정책에 따릅니다.
⑥ 앱을 삭제하는 것만으로 구독이 자동 해지되지는 않습니다. 이용자는 해당 앱 마켓의 구독 관리 화면에서 구독을 직접 해지하여야 합니다.
제9조 (청약철회 및 환불)
① 이용자의 청약철회, 계약 취소 및 환불 권리는 「전자상거래 등에서의 소비자보호에 관한 법률」, 「콘텐츠산업 진흥법」 및 기타 관계 법령이 정하는 범위에서 보장됩니다.
② 앱 마켓을 통해 결제한 경우 결제 취소, 구독 해지 및 환불 신청은 원칙적으로 해당 앱 마켓이 제공하는 절차를 통해 진행됩니다.
③ 운영자는 앱 마켓의 결제 또는 환불 심사 결과를 임의로 변경할 수 없습니다. 다만, 관계 법령에 따라 운영자에게 책임이 인정되는 경우에는 앱 마켓과 협조하여 필요한 조치를 취합니다.
④ 디지털 콘텐츠 또는 유료 서비스의 제공이 시작된 경우에는 관계 법령이 정한 요건과 사전 고지 여부에 따라 청약철회가 제한될 수 있습니다.
⑤ 가분적인 디지털 콘텐츠 또는 서비스로 구성된 상품은 아직 제공이 시작되지 않은 부분에 대해 관계 법령에 따라 청약철회가 가능할 수 있습니다.
⑥ 다음 각 호의 경우에는 관계 법령 및 앱 마켓 정책에 따라 청약철회 또는 환불이 제한될 수 있습니다.
1. 디지털 콘텐츠 또는 서비스의 제공이 이미 시작되었고 법령상 청약철회 제한 요건을 충족한 경우
2. 이용자의 사용 또는 소비로 콘텐츠의 가치가 현저히 감소한 경우
3. 이용자의 책임 있는 사유로 서비스 이용 권한이나 콘텐츠가 훼손된 경우
4. 기타 관계 법령 또는 앱 마켓 정책이 정한 환불 제한 사유에 해당하는 경우
⑦ 콘텐츠나 서비스의 내용이 표시·광고 또는 계약 내용과 다르게 제공된 경우 이용자는 관계 법령이 정한 기간 내에 청약철회, 환불 또는 필요한 조치를 요청할 수 있습니다.
⑧ 본 앱은 의료기기, 의료 서비스 또는 치료 수단이 아니며 수면 개선이나 질환 치료 등의 효과를 보장하지 않습니다. 단순히 이용자가 기대한 의료적·치료적 효과가 발생하지 않았다는 사정만으로 운영자가 별도의 환불을 보장하지는 않습니다. 다만, 관계 법령이나 앱 마켓 정책에 따라 환불이 인정되는 경우는 제외합니다.
⑨ 청약철회가 제한되는 유료 서비스의 경우 운영자는 구매 화면 또는 결제 과정에서 이용자가 이를 확인할 수 있도록 표시합니다.
제10조 (지식재산권)
① 앱 및 서비스에 포함된 음원, 디자인, 로고, 사용자 인터페이스, 텍스트, 이미지 및 기타 콘텐츠에 관한 지식재산권은 운영자 또는 정당한 권리자에게 귀속됩니다.
② 이용자는 운영자의 사전 서면 동의 없이 앱 또는 콘텐츠를 다음과 같은 방법으로 이용할 수 없습니다.
1. 복제, 수정, 편집 또는 배포
2. 인터넷 또는 기타 매체를 통한 전송
3. 공연, 방송 또는 공중송신
4. 2차적 저작물 작성
5. 판매, 대여 또는 기타 상업적 이용
③ 이용자는 앱과 서비스에 대해 개인적이고 비상업적인 이용을 위한 비독점적·양도 불가능한 사용 권한만을 부여받습니다.
④ 본 약관은 앱이나 콘텐츠에 관한 소유권 또는 지식재산권을 이용자에게 이전하는 것으로 해석되지 않습니다.
제11조 (서비스 제공의 중단)
① 운영자는 다음 각 호의 경우 서비스 제공을 일시적으로 중단할 수 있습니다.
1. 시스템 점검, 업데이트 또는 유지보수
2. 서버, 네트워크 또는 통신 장애
3. 보안 사고 또는 비정상적인 접근 발생
4. 천재지변, 전쟁, 감염병, 정전 등 불가항력
5. 법령, 정부기관의 명령 또는 앱 마켓 정책 변경
6. 기타 서비스의 안정적인 운영을 위해 필요한 경우
② 사전에 예상할 수 있는 서비스 중단은 앱 내 공지 또는 기타 적절한 방법으로 미리 알립니다.
③ 긴급한 보안 조치, 장애 또는 불가항력으로 사전 공지가 어려운 경우에는 사후에 알릴 수 있습니다.
④ 운영자의 귀책사유로 유료 서비스가 상당 기간 제공되지 못한 경우 운영자는 관계 법령과 앱 마켓 정책에 따라 이용기간 연장, 대체 서비스 제공, 환불 또는 기타 적절한 조치를 취합니다.
제12조 (면책조항)
① 운영자는 천재지변, 전쟁, 정전, 통신망 장애, 앱 마켓 장애 등 운영자가 합리적으로 통제할 수 없는 사유로 발생한 서비스 이용 장애에 대해 운영자에게 고의 또는 과실이 없는 경우 책임을 지지 않습니다.
② 본 앱은 의료 서비스, 의료기기 또는 의약품이 아니며, 운영자는 다음 각 호의 효과를 보장하지 않습니다.
1. 수면의 질 개선 또는 수면 시간 증가
2. 불면증, 수면장애, 불안장애, 우울증, ADHD 등 의학적 증상의 완화 또는 치료
3. 집중력, 기억력 또는 학습 능력 향상
4. 정서적 안정, 스트레스 감소 또는 정신 건강 개선
5. 영유아의 수면 유도 또는 진정 효과
6. 기타 의학적·치료적·건강상의 효과
③ 이용자가 의료적 도움이 필요한 상태에서 본 앱만을 의존하여 적절한 진료나 치료를 받지 않아 발생한 손해에 대해서는 운영자에게 고의 또는 과실이 없는 한 운영자가 책임을 지지 않습니다.
④ 이용자는 청각 보호를 위해 적정 음량과 이용 시간을 유지하여야 합니다.
⑤ 이용자의 과도한 음량 설정, 기기 자체의 결함, 운영체제 오류, 네트워크 환경 또는 이용자의 부주의로 발생한 손해에 대해서는 운영자에게 고의 또는 과실이 없는 한 운영자가 책임을 지지 않습니다.
⑥ 운영자가 직접 작성·승인·의뢰하지 않은 광고, 외부 링크, 제3자 후기, 게시물 또는 인플루언서 콘텐츠의 내용에 대해서는 운영자에게 고의 또는 과실이 없는 한 운영자가 책임을 지지 않습니다.
⑦ 이용자가 본 약관 또는 관계 법령을 위반하여 발생한 손해에 대해서는 해당 이용자가 책임을 부담합니다.
⑧ 본 조의 면책 및 책임 제한은 관련 법령이 허용하는 범위에서만 적용되며, 운영자의 고의 또는 중대한 과실로 발생한 손해에 대해서는 적용되지 않습니다.
⑨ 관련 법령에 따라 운영자의 손해배상 책임이 인정되는 경우 본 조를 이유로 해당 책임을 부당하게 제한하거나 배제하지 않습니다.
제13조 (개인정보 보호)
① 운영자는 「개인정보 보호법」 등 관계 법령에 따라 이용자의 개인정보를 보호합니다.
② 개인정보의 수집, 이용, 제공, 보유, 국외 이전 및 파기에 관한 구체적인 사항은 별도로 게시하는 개인정보처리방침에 따릅니다.
③ 개인정보처리방침은 앱 내 설정 화면, 운영자가 제공하는 웹페이지 또는 앱 마켓 제품 페이지에 게시된 링크를 통해 확인할 수 있습니다.
④ 앱의 실제 개인정보 처리 내용과 개인정보처리방침, 앱 마켓 개인정보 표시 내용은 서로 일치하도록 관리합니다.
제14조 (약관의 변경)
① 운영자는 관계 법령을 위반하지 않는 범위에서 본 약관을 변경할 수 있습니다.
② 운영자가 약관을 변경하는 경우 변경 내용, 변경 사유 및 시행일을 명시하여 시행일 최소 7일 전에 앱 내 공지 또는 기타 적절한 방법으로 알립니다.
③ 이용자에게 불리하거나 권리·의무에 중대한 영향을 미치는 변경은 시행일 최소 30일 전에 알립니다.
④ 관계 법령에 따라 이용자의 명시적인 동의가 필요한 변경은 별도의 동의 절차를 거칩니다.
⑤ 명시적 동의가 요구되지 않는 변경에 대해 운영자가 다음 각 호의 내용을 명확히 별도로 고지했음에도 이용자가 시행일까지 거부 의사를 표시하지 않고 변경된 약관 시행 이후에도 서비스를 계속 이용한 경우에는 관계 법령이 허용하는 범위에서 변경 약관에 동의한 것으로 볼 수 있습니다.
1. 약관이 변경된다는 사실
2. 변경된 약관의 주요 내용
3. 시행일
4. 동의하지 않을 경우 이용계약을 해지하거나 서비스 이용을 중단할 수 있다는 사실
5. 정해진 기간까지 거부 의사를 표시하지 않으면 동의한 것으로 볼 수 있다는 사실
⑥ 이용자가 변경된 약관에 동의하지 않는 경우 서비스 이용을 중단하고 이용계약을 해지할 수 있습니다.
⑦ 약관 변경으로 인해 이미 결제한 유료 서비스의 이용조건이 이용자에게 중대하게 불리해지는 경우 운영자는 관계 법령과 앱 마켓 정책에 따라 필요한 조치를 취합니다.
제15조 (분쟁의 해결)
① 운영자와 이용자 사이에 분쟁이 발생한 경우 상호 협의를 통해 원만하게 해결하는 것을 원칙으로 합니다.
② 협의로 해결되지 않는 경우 이용자는 한국소비자원, 콘텐츠분쟁조정위원회 또는 기타 관계 법령에 따른 분쟁조정기관에 조정을 신청할 수 있습니다.
③ 분쟁조정 신청은 이용자의 법률상 권리 또는 법원에 소송을 제기할 권리를 제한하지 않습니다.
제16조 (준거법 및 관할)
① 본 약관은 대한민국 법률에 따라 해석되고 적용됩니다.
② 본 약관 또는 서비스 이용과 관련하여 소송이 발생하는 경우 관할 법원은 「민사소송법」 등 관계 법령이 정하는 바에 따릅니다.
제17조 (Apple 관련 고지)
본 조는 Apple App Store를 통해 배포되는 앱에 적용됩니다.
1. 계약 당사자
본 약관은 운영자와 이용자 사이에 체결되는 것이며 Apple과 체결되는 것이 아닙니다. 앱과 앱 콘텐츠에 관한 책임은 관련 법령이 허용하는 범위에서 운영자에게 있습니다.
2. 라이선스의 범위
이용자는 Apple Media Services Terms and Conditions의 사용 규칙에 따라 자신이 소유하거나 관리하는 Apple 브랜드 제품에서 앱을 사용할 수 있는 양도 불가능한 라이선스를 부여받습니다. Family Sharing 또는 Apple이 허용하는 볼륨 구매를 통해 연결된 다른 계정이 앱을 이용하는 경우를 포함합니다.
3. 유지보수 및 지원
앱에 관한 유지보수와 고객지원 책임은 운영자에게 있으며 Apple은 앱에 관한 유지보수 또는 지원 서비스를 제공할 의무가 없습니다.
4. 보증
앱이 적용 가능한 법적 보증을 충족하지 못하는 경우 이용자는 Apple에 이를 알릴 수 있으며, Apple은 적용 가능한 경우 앱의 구매 가격을 환불할 수 있습니다. 관련 법령이 허용하는 최대 범위에서 Apple은 그 밖의 보증 의무를 부담하지 않으며, 앱의 보증 위반으로 발생한 청구에 관한 책임은 운영자에게 있습니다.
5. 제품 관련 청구
앱 또는 이용자의 앱 소유·이용과 관련하여 발생하는 다음 청구는 Apple이 아닌 운영자가 관계 법령에 따라 처리합니다.
가. 제조물 책임에 관한 청구
나. 앱이 법률 또는 규제 요건을 충족하지 못한다는 청구
다. 소비자 보호, 개인정보 보호 또는 유사 법령에 따른 청구
라. 앱 또는 앱 이용과 관련된 이용자나 제3자의 기타 청구
6. 지식재산권 청구
제3자가 앱 또는 이용자의 앱 사용이 자신의 지식재산권을 침해한다고 주장하는 경우 해당 청구의 조사, 방어, 합의 및 해결 책임은 Apple이 아닌 운영자에게 있습니다.
7. 법률 준수 및 수출 통제
이용자는 다음 각 목의 사항을 진술하고 보증합니다.
가. 미국 정부의 금수조치 대상 국가 또는 미국 정부가 테러 지원국으로 지정한 국가에 거주하지 않습니다.
나. 미국 정부의 금지 또는 제한 대상자 명단에 포함되어 있지 않습니다.
8. 개발자 연락처

이용자는 앱 이용 시 Apple Media Services Terms and Conditions, 이동통신사 약관 및 적용 가능한 제3자 서비스 약관을 준수하여야 합니다.
10. 제3수익자
이용자와 운영자는 Apple 및 Apple의 자회사가 본 약관의 제3수익자임을 인정하고 동의합니다. 이용자가 본 약관에 동의한 경우 Apple은 제3수익자로서 이용자에게 본 약관을 집행할 권리를 가집니다.
11. 상표
Apple, Apple 로고 및 App Store는 Apple Inc.의 상표 또는 등록상표입니다.

White Noise App Terms of Service

These Terms of Service (the "Terms") set forth the rights, obligations, responsibilities, and other necessary matters between users and SGTHL (the "Operator") in connection with the White Noise mobile application (the "App") and all related services (the "Service") provided by the Operator.
Before using the Service, users must review and agree to these Terms when first launching the App, purchasing a paid service, or otherwise completing the applicable consent process. In particular, please carefully review Article 2 regarding the nature and limitations of the Service and Article 12 regarding disclaimers.
Article 1 (Purpose)
These Terms govern the conditions and procedures for using the white noise, nature sounds, sleep-support audio, and related services provided by the Operator, as well as the rights, obligations, and responsibilities of users and the Operator.
Article 2 (Nature and Limitations of the Service)
① The App is an entertainment and lifestyle-support application that provides audio content such as white noise and nature sounds to help create an environment for everyday relaxation, sleep, and concentration.
② The App is not any of the following:
1. A medical device or equivalent product
2. A tool for medical diagnosis, treatment, or prevention
3. A means of treating medical conditions such as insomnia, sleep disorders, anxiety disorders, depression, or attention-deficit/hyperactivity disorder (ADHD)
4. A pharmaceutical product or substitute for a pharmaceutical product
5. A medical aid intended to induce sleep or calm infants or young children
③ The Operator does not guarantee that using the App will produce any of the following effects:
1. Improved sleep quality or increased sleep duration
2. Relief from or treatment of medical symptoms such as insomnia, sleep disorders, or anxiety disorders
3. Improved concentration, memory, or learning ability
4. Emotional stability, stress reduction, or improved mental health
5. Induction of sleep or a calming effect for infants or young children
④ Users who need medical assistance should consult a qualified healthcare professional. Use of the App is not a substitute for professional diagnosis or treatment.
⑤ Any claim regarding medical or therapeutic efficacy made in an external advertisement, review, post, or third-party content that was not directly created, approved, or commissioned by the Operator does not represent the Operator's official position.
⑥ The Operator's official position is limited to statements published in these Terms, the Privacy Policy, and official channels directly operated by the Operator.
⑦ Users must use the Service with an understanding of the nature and limitations described in this Article.
Article 3 (Definitions)
The following terms have the meanings set forth below:
1. "App" means the White Noise mobile application provided by the Operator.
2. "Service" means all content and features provided through the App by the Operator.
3. "User" means a person who agrees to these Terms and uses the Service.
4. "Premium Service" means a service available through a subscription, in-app purchase, or other paid transaction.
5. "Content" means audio, images, text, and other materials provided through the App.
6. "App Market" means a platform that distributes the App and processes payments, such as the Apple App Store or Google Play.
Article 4 (Service Details and Changes)
① The Operator may provide the following services:
1. White noise and nature-sound audio content
2. Features that support the creation of sleep and concentration environments
3. Timer and repeat-playback features
4. Favorites and user-setting features
5. A free-use period of 14 days from first use
6. Premium Services provided through subscriptions or in-app purchases
7. Other services additionally developed or provided by the Operator
② The Operator may change or add part of the Service as necessary for service improvement, maintenance, technical requirements, or operational needs.
③ If a change to the Service materially affects users, the Operator will provide advance notice of the change and its effective date through an in-app notice, email, or another reasonable method.
④ If the Operator discontinues or materially changes a core element of a paid service to the user's disadvantage, the Operator will take necessary measures in accordance with applicable law and App Market policies, which may include providing an alternative service, extending the service period, or issuing a refund.
Article 5 (Formation of the Service Agreement and User Eligibility)
① The service agreement is formed when the user reviews and agrees to these Terms in the App and then uses the Service.
② If a child under 14 uses a service that requires the provision of personal information or creation of an account, consent from a legal representative must be obtained.
③ A minor may be required to obtain consent from a legal representative to purchase a paid service, as provided by applicable law.
④ If a minor makes a payment without the consent of a legal representative, the minor or legal representative may cancel the contract in accordance with applicable law. This does not apply where cancellation is restricted by law, including where the payment was made within the scope of property that the legal representative permitted the minor to dispose of.
⑤ Requests to cancel or refund payments made through an App Market are, in principle, handled through the procedures provided by that App Market.
⑥ When a guardian uses the App near an infant, young child, or person requiring medical supervision, the guardian must manage the volume, duration of use, device placement, and surrounding environment appropriately.
Article 6 (User Obligations)
① Users must not engage in any of the following conduct:
1. Interfering with the normal operation of the App or Service
2. Using the App for an unlawful purpose
3. Infringing the intellectual property rights of the Operator or any third party
4. Reproducing, distributing, selling, transmitting, or commercially using in-App Content without authorization
5. Attempting to analyze the structure or source code of the App through hacking, reverse engineering, decompilation, abnormal data access, or similar conduct
6. Manipulating or extending the free-use period or subscription entitlement by improper means
7. Using another person's account, personal information, or payment method without authorization
8. Violating the Apple Media Services Terms and Conditions, Google Play Terms of Service, mobile carrier terms, or any applicable third-party service terms
9. Presenting, advertising, or disseminating the App in a manner that could cause it to be mistaken for a medical device or treatment, or as though it has medical efficacy
10. Engaging in any other conduct that violates applicable law or public order
② If a user violates these Terms or applicable law, the Operator may issue a warning, restrict use of the Service, or terminate the service agreement depending on the severity of the violation.
③ In principle, the Operator will notify the user of the reason for a restriction. However, this does not apply where an urgent security measure is required or notice is restricted by law.
Article 7 (Third-Party Services)
① The App does not include advertisements and does not process user information for advertising revenue.
② The Operator may use the following third-party services to analyze errors, analyze Service usage statistics, verify the free-use period, and improve quality:
1. Google Firebase services such as Firebase Analytics, Firebase Crashlytics, and Cloud Firestore
3. App distribution, payment, and analytics services provided by Apple
4. App distribution, payment, and analytics services provided by Google
5. Other analytics, error-analysis, and security services necessary to operate the App
③ The Privacy Policy governs the third-party services actually used, the categories of information collected, purposes of use, retention periods, cross-border transfers, and disclosures to third parties.
④ The information actually collected may vary depending on App features, App version, user consent, operating system, and device settings.
⑤ The Operator does not warrant the content, accuracy, or reliability of external services, external links, or third-party content that the Operator did not directly create, approve, or commission.
⑥ Even if third-party content or an external post implies a medical or therapeutic effect, it is not deemed the Operator's official position unless the Operator directly approved or commissioned it.
Article 8 (Paid Services and Subscriptions)
① Some Content or features of the App may be offered for a fee through a subscription, in-app purchase, or another payment method.
② The price, billing cycle, service period, auto-renewal terms, and details of a paid service are displayed on the purchase screen. Prices may be displayed differently depending on the user's country and the App Market currency.
③ Payments are processed through the payment system of the Apple App Store, Google Play, or another applicable App Market from which the user downloaded the App.
④ Auto-renewing subscriptions operate as follows:
1. Unless the user disables auto-renewal before the end of the current subscription period, the subscription may automatically renew under the terms displayed on the purchase screen.
2. The timing of a renewal charge is governed by the applicable App Market's policy and the information displayed on the purchase screen.
3. Users may disable auto-renewal through subscription management in their Apple Account or recurring-payment management in Google Play.
4. The Operator provides all App features free of charge for 14 days from first use. This free-use period is provided directly by the Operator and is not an App Market free-trial product; therefore, no paid subscription starts and no charge is made automatically when the period ends. To continue using the App after the free-use period, the user must select and purchase a subscription, at which point the auto-renewal terms above apply. Deleting and reinstalling the App does not restart the free-use period.
⑤ Cancellation of a subscription generally takes effect from the next billing date. Continued access during a paid subscription period and refund eligibility are governed by applicable law and App Market policies.
⑥ Deleting the App does not automatically cancel a subscription. Users must cancel directly through subscription management in the applicable App Market.
Article 9 (Withdrawal, Cancellation, and Refunds)
① Users' rights to withdraw from a purchase, cancel a contract, and obtain a refund are protected to the extent provided by the Act on the Consumer Protection in Electronic Commerce, the Content Industry Promotion Act, and other applicable laws of the Republic of Korea.
② If payment was made through an App Market, requests to cancel payment, cancel a subscription, or obtain a refund must, in principle, be submitted through the procedures provided by that App Market.
③ The Operator cannot unilaterally change an App Market's payment or refund determination. However, where the Operator is responsible under applicable law, the Operator will cooperate with the App Market and take necessary measures.
④ Once the supply of digital Content or a paid service has begun, the right of withdrawal may be restricted depending on the requirements of applicable law and whether the required advance notice was provided.
⑤ If a product consists of divisible digital Content or services, withdrawal may be available under applicable law for any portion whose supply has not yet begun.
⑥ Withdrawal or a refund may be restricted under applicable law and App Market policies in any of the following cases:
1. Supply of the digital Content or service has already begun and the statutory conditions for restricting withdrawal have been satisfied.
2. The value of the Content has materially decreased due to the user's use or consumption.
3. The service entitlement or Content has been impaired due to a cause attributable to the user.
4. Another ground for restricting refunds under applicable law or App Market policies applies.
⑦ If Content or a service is provided differently from its description, advertisement, or contractual terms, the user may request withdrawal, a refund, or another necessary remedy within the period prescribed by applicable law.
⑧ The App is not a medical device, medical service, or treatment and does not guarantee effects such as improved sleep or treatment of a condition. The Operator does not separately guarantee a refund solely because a user did not experience the medical or therapeutic effect that the user expected. This does not apply where a refund is available under applicable law or App Market policies.
⑨ If withdrawal is restricted for a paid service, the Operator will display the restriction so that the user can review it on the purchase screen or during the payment process.
Article 10 (Intellectual Property Rights)
① Intellectual property rights in the audio, designs, logos, user interfaces, text, images, and other Content included in the App and Service belong to the Operator or the applicable lawful rights holder.
② Without the Operator's prior written consent, users may not use the App or Content in any of the following ways:
1. Reproduction, modification, editing, or distribution
2. Transmission over the Internet or through another medium
3. Public performance, broadcasting, or communication to the public
4. Creation of derivative works
5. Sale, rental, or other commercial use
③ Users receive only a non-exclusive, non-transferable right to use the App and Service for personal, non-commercial purposes.
④ These Terms do not transfer to users any ownership or intellectual property right in the App or Content.
Article 11 (Suspension of the Service)
① The Operator may temporarily suspend the Service in any of the following circumstances:
1. System inspection, updates, or maintenance
2. Server, network, or telecommunications failure
3. A security incident or abnormal access
4. Force majeure, including natural disasters, war, infectious disease, or power outage
5. A change in law, an order from a government authority, or a change in App Market policy
6. Any other circumstance requiring suspension for the stable operation of the Service
② If a service interruption can be anticipated, the Operator will provide advance notice through an in-App notice or another appropriate method.
③ If advance notice is impracticable because of an urgent security measure, failure, or force majeure, the Operator may provide notice after the event.
④ If a paid service is unavailable for a substantial period due to a cause attributable to the Operator, the Operator will take appropriate measures in accordance with applicable law and App Market policies, which may include extending the service period, providing an alternative service, or issuing a refund.
Article 12 (Disclaimers)
① The Operator is not liable for a disruption in the use of the Service caused by circumstances beyond the Operator's reasonable control, such as natural disaster, war, power outage, telecommunications network failure, or App Market failure, where the Operator is not at fault.
② The App is not a medical service, medical device, or pharmaceutical product, and the Operator does not guarantee any of the following effects:
1. Improved sleep quality or increased sleep duration
2. Relief from or treatment of medical symptoms such as insomnia, sleep disorders, anxiety disorders, depression, or ADHD
3. Improved concentration, memory, or learning ability
4. Emotional stability, stress reduction, or improved mental health
5. Induction of sleep or a calming effect for infants or young children
6. Any other medical, therapeutic, or health effect
③ Where a user who needs medical assistance relies solely on the App and fails to obtain appropriate diagnosis or treatment, the Operator is not liable for resulting damage unless the Operator acted intentionally or negligently.
④ Users must maintain an appropriate volume and duration of use to protect their hearing.
⑤ The Operator is not liable for damage caused by excessive volume settings, defects in the user's device, operating-system errors, the network environment, or user negligence unless the Operator acted intentionally or negligently.
⑥ The Operator is not liable for the content of advertisements, external links, third-party reviews, posts, or influencer content that the Operator did not directly create, approve, or commission unless the Operator acted intentionally or negligently.
⑦ A user is responsible for damage arising from the user's violation of these Terms or applicable law.
⑧ The disclaimers and limitations of liability in this Article apply only to the extent permitted by applicable law and do not apply to damage caused by the Operator's intentional misconduct or gross negligence.
⑨ Where the Operator is liable for damages under applicable law, this Article does not improperly limit or exclude that liability.
Article 13 (Protection of Personal Information)
① The Operator protects users' personal information in accordance with the Personal Information Protection Act of the Republic of Korea and other applicable laws.
② The separately published Privacy Policy governs the collection, use, disclosure, retention, cross-border transfer, and destruction of personal information.
③ The Privacy Policy is available through the settings screen in the App, a webpage provided by the Operator, or a link on the App Market product page.
④ The Operator manages the App's actual personal-information practices, the Privacy Policy, and the App Market privacy disclosures so that they remain consistent.
Article 14 (Changes to These Terms)
① The Operator may amend these Terms to the extent that the amendment does not violate applicable law.
② If the Operator amends these Terms, the Operator will provide notice of the changes, the reason for the changes, and the effective date through an in-App notice or another appropriate method at least seven days before the effective date.
③ A change that is unfavorable to users or materially affects their rights or obligations will be announced at least 30 days before its effective date.
④ If applicable law requires express user consent for a change, the Operator will implement a separate consent process.
⑤ Where express consent is not required, a user may be deemed to have agreed to the amended Terms to the extent permitted by applicable law if the Operator has clearly provided separate notice of all of the following, and the user does not express an objection by the effective date and continues to use the Service after the amended Terms take effect:
1. The fact that these Terms will be amended
2. The principal terms of the amendment
3. The effective date
4. The fact that a user who does not agree may terminate the service agreement or stop using the Service
5. The fact that failure to express an objection by the specified deadline may be deemed consent
⑥ A user who does not agree to the amended Terms may stop using the Service and terminate the service agreement.
⑦ If an amendment materially disadvantages the user with respect to the conditions of an already-paid service, the Operator will take necessary measures in accordance with applicable law and App Market policies.
Article 15 (Dispute Resolution)
① If a dispute arises between the Operator and a user, the parties will first seek an amicable resolution through mutual consultation.
② If the dispute is not resolved through consultation, the user may apply for mediation to the Korea Consumer Agency, the Content Dispute Resolution Committee, or another dispute-resolution body established under applicable law.
③ An application for dispute mediation does not limit the user's legal rights or right to bring an action in court.
Article 16 (Governing Law and Jurisdiction)
① These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
② If litigation arises in connection with these Terms or use of the Service, jurisdiction is determined in accordance with the Civil Procedure Act of the Republic of Korea and other applicable laws.
Article 17 (Apple-Specific Notice)
This Article applies to the App when distributed through the Apple App Store.
1. Contracting Parties
These Terms are entered into between the Operator and the user, not with Apple. To the extent permitted by applicable law, the Operator is responsible for the App and its Content.
2. Scope of License
The user is granted a non-transferable license to use the App on any Apple-branded product that the user owns or controls, subject to the Usage Rules in the Apple Media Services Terms and Conditions. This includes use by other accounts associated with the user through Family Sharing or volume purchasing where permitted by Apple.
3. Maintenance and Support
The Operator is responsible for maintenance and support for the App. Apple has no obligation to provide maintenance or support services for the App.
4. Warranty
If the App fails to conform to an applicable warranty, the user may notify Apple, and Apple may refund the purchase price for the App where applicable. To the maximum extent permitted by applicable law, Apple has no other warranty obligation. The Operator is responsible for claims arising from a failure of the App to conform to a warranty.
5. Product Claims
The Operator, not Apple, is responsible under applicable law for addressing the following claims relating to the App or the user's possession or use of the App:
a. Product-liability claims
b. Claims that the App fails to conform to a legal or regulatory requirement
c. Claims arising under consumer-protection, privacy, or similar laws
d. Any other claim by a user or third party relating to the App or its use
6. Intellectual Property Claims
If a third party claims that the App or the user's use of the App infringes that third party's intellectual property rights, the Operator, not Apple, is responsible for the investigation, defense, settlement, and resolution of the claim.
7. Legal Compliance and Export Controls
The user represents and warrants the following:
a. The user is not located in a country subject to a United States Government embargo or designated by the United States Government as a terrorist-supporting country.
b. The user is not listed on any United States Government list of prohibited or restricted parties.
8. Developer Contact Information
Questions, complaints, or claims regarding the App may be submitted using the Operator's contact information in Article 18.
9. Compliance with Third-Party Terms
When using the App, users must comply with the Apple Media Services Terms and Conditions, applicable mobile carrier terms, and applicable third-party service terms.
10. Third-Party Beneficiary
The user and the Operator acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon the user's acceptance of these Terms, Apple has the right to enforce these Terms against the user as a third-party beneficiary.
11. Trademarks
Apple, the Apple logo, and App Store are trademarks or registered trademarks of Apple Inc.
